$20M award upheld for fatal drowning

COLUMBIA, S.C. — The South Carolina Court of Appeals affirmed a jury award to the tune of $20 million, which must be paid by a lifeguard company to a family whose son died of drowning at a resort in Myrtle Beach. The award includes $7 million in punitive damages, owed because the family brought “plentiful evidence” that the company breached the standard of professional care, e.g. by requiring its lifeguards to operate concession stands while on duty for as much as “99.995% of the time” while working, a figure offered by its own admission in an earlier lawsuit.
