INSURANCE – The 2nd Circuit vacates dismissal of plaintiff’s claim for long-term disability benefits, based on answers to certified questions from the New York Court of Appeals. The state court responded that the state Insurance Law lets insurers toll benefits for disabilities stemming from pre-existing conditions during the first 12 months of coverage, but does not let them impose an absolute bar on coverage for those disabilities.
