6th Circuit boots Kentucky flood suit

CINCINNATI — The Sixth Circuit ruled in favor of an eastern Kentucky mining company that was sued by dozens of homeowners whose property was damaged in severe flooding allegedly exacerbated by the mine’s failure to reclaim disturbed land. The plaintiffs’ only causation expert’s reports were excluded by the trial court, which did not abuse its discretion in finding his reports irrelevant or unreliable. Without the expert’s reports, the issue of causation could not be placed before a jury.
