9th Circuit

IMMIGRATION – The 9th Circuit reversed an immigration judge’s finding that a petitioner was removable on the basis that his conviction for misdemeanor assault was an aggravated felony. Fourth-degree assault under Washington law is not categorically a crime of violence, the court ruled, and the modified categorical approach does not establish that his conviction was based on a crime of violence.
