9th Circuit

CONSTITUTION, PROPERTY – The 9th Circuit rejected claims that Santa Monica’s rent control ordinance is unconstitutional under the Fifth Amendment’s takings clause and the 14th Amendment’s due process clause. The judges concluded that the Fifth Amendment claims are not viable, the facial 14th Amendment claim is time-barred, and the 14th Amendment claim is unripe. See ruling.
