TORT, DAMAGES – The 9th Circuit upheld the apportionment of liability in a personal injury claim filed by a man who was seriously injured when a friend ran him over with a snowmobile on the Big Sky snowmobile trail in Montana. The lower court correctly determined that the U.S. Forest Service was 40 percent liable for the accident, while the plaintiff and his two friends shared 60 percent of the blame.
