An Illinois federal court granted the American Academy of Pediatrics a preliminary injunction blocking a Florida enforcement lawsuit that accused the nonprofit pediatricians’ organization of deceptive trade practices, racketeering and antitrust violations based on its advocacy for gender-affirming care for transgender youth. The academy plausibly alleged Florida Attorney General James Uthmeier filed the suit to punish and suppress its protected speech. The Florida complaint contains significant misrepresentations of the academy’s policy statements, rests on a weak theory that its medical guidance constituted commercial speech and appears to have been brought in bad faith without a reasonable expectation of success.

An Alabama federal court granted summary judgment to a county sheriff and dismissed a former deputy’s religious discrimination and free speech claims. A coworker said the former deputy’s personal Facebook contained “numerous anti LGBT and misogynistic posts,” then former deputy explained to a sergeant that he was a Christian first and a deputy second, and alleged that the supervisor then referred to him as “Bible-thumping asshole.” The ex-deputy cannot “simply use ‘religious belief’ as a shield against the effects” of expression “not exclusively religious in nature” that may negatively affect the workplace and cause public concern.

A Minnesota federal court denied a class of produce companies’ motion to reconsider the court’s previous denial of class certification for fiduciary duty claims. Since the fiduciary duties and contracts in question are not uniform, the court would have to comb through around 1,400 individual contracts to see if the sued logistics company actually owed a fiduciary duty to every single class member. Additionally, the financial stakes for individual growers are high enough that they could sue on their own.

A federal court in Louisiana granted summary judgment to Amazon on a contract maintenance worker’s negligence, vicarious liability and premises liability lawsuit he filed after he “suddenly lost consciousness and began convulsing on the floor” while working alone in a warehouse. His fall activated a security alarm, but Amazon personnel were absent from their assigned positions, resulting in a half-hour delay in emergency aid, “during which time he repeatedly struck his head and back.” The Amazon employees had “no duty” to come to his aid and the court found no law governing a warehouse owner’s liability for “non-work related medal emergencies experienced by independent contractors on its premises.”

A federal court in Illinois declined to grant a retired judge’s motion for a preliminary injunction seeking reinstatement to a temporary Cook County judicial assignment after the Illinois Supreme Court removed him over politically charged articles and podcast comments without notice or a hearing. Abstention is appropriate because unresolved questions of Illinois constitutional law concerning judicial assignments and discipline should first be addressed by Illinois courts, though the judge has plausibly alleged due process and free speech violations.
