Baby food contamination

NEW ORLEANS -- The Fifth Circuit reversed a lower court’s decision to dismiss Whole Foods from a consumer suit claiming its sale of contaminated Earth’s Best Organic baby food caused their son’s heavy metal poisoning, contributing to his neurological conditions and autism diagnosis. Whole Foods' business model depends on its reputation and customers’ willingness to a pay a premium for products advertised as healthy and high quality. The consumers reasonably claim to have relied on Whole Foods’ vetting process to ensure that its products are free of harmful ingredients.
