‘Career criminal’ enhancement undone

CHICAGO — The Seventh Circuit vacated the conviction and sentence of a man who was tried for firearm possession by a convicted felon. His sentence was enhanced by the Armed Career Criminal Act, and though he pleaded guilty to firearm possession and had three previous robbery convictions, he says two of those robberies were committed on the same occasion. The Supreme Court recently held the Fifth and Sixth Amendments require a jury to decide such questions for ACCA sentence enhancement purposes.
