OAKLAND, Calif. — The U.S. Environmental Protection Agency failed to do its nondiscretionary duty to fail Arizona and Kentucky for not revising air standards for fine particulate matter in the Phoenix, Tucson and Louisville areas, the Center for Biological Diversity claims in Federal Court.
