ATTORNEYS, CIVIL PROCEDURE – The lower court dismissed plaintiff’s legal malpractice suit accusing an attorney of failing to advise that undue delay in filing its patent infringement suit could give rise to a laches defense. The appeals court held that the plaintiff failed to offer evidence that the lawyer’s advice led to the plaintiff’s inability to sue three years after the defendant was replaced by other counsel.
