Court Remands Claims Over Hurricane Damage

ATLANTA (CN) – The **11th Circuit has allowed Florida residents to pursue class certification of their claim that Foremost Insurance Co. failed to adequately compensate them for hurricane damage.     The district court found that, in order for plaintiffs to have standing, they have to repair or replace their damaged property and submit the expenses to their insurer.     The appeals court ruled that plaintiffs should have been able to conduct the relevant discovery, so that the lower court could determine whether an evidentiary hearing was necessary. Remanded. See ruling.
