Covid loans suit flops

MANHATTAN — The Second Circuit upheld the dismissal of a lawsuit challenging the American Recovery Plan Act’s provision that gave businesses owned by women, veteran and minorities priority in receiving Covid-era small business grants. The restaurant owners who sued cannot amend their lawsuit to include a Bivens claim because, the appellate court said, other remedies exist for their alleged injuries.
