Fish ladder dispute reopened

MERCED, Calif. — An appeals court in California reversed the trial court’s dismissal of a petition seeking to force an irrigation district to reopen a fish ladder on a Merced River dam that was closed in 1970. The trial court properly dismissed a public nuisance cause of action, but a dispute exists over whether the district breached a duty to reopen the fish ladder.
