Fourth Circuit

IMMIGRATION, EVIDENCE – In the 4th Circuit , J. Motz finds that while the lower court found that the identity of a defendant is never suppressible, immigration agents testified that they arrested defendant simply to deport him, and that a criminal prosecution was only later contemplated. Thus, fingerprint evidence and immigrant records were exploited. Reversed. See ruling in US v. Oscar-Torres.
