CENTRAL ISLIP, N.Y. — A federal court in New York penned a whimsical ruling dismissing most class action false advertising claims against the parent company of the Cold Stone Creamery ice cream shops, except for one claim alleging its pistachio flavor misleadingly and inaccurately suggests there are pistachio nuts in its pistachio ice cream. The suing consumer brought customer surveys showing 85% of those polled expected there to be pistachios in the product.
