Gun to the head

NEW ORLEANS — The Fifth Circuit dismissed the appeal of a lower court’s decision denying a Jacksonville police investigator’s motion for judgment on a female officer’s excessive force and sex discrimination claims. The investigator allegedly pointed his loaded service revolver directly at the woman’s forehead, saying, “I wasn’t talking to you,” before lowering it and apologizing. The appellate court cannot consider the genuineness of the district court’s determinations regarding fact issues.
