Hearing first, shutoff second

PITTSBURGH, Penn. — A Pennsylvania court denied a utility’s motion to dismiss a due process lawsuit brought by a property owner who sued after his water and sewer services were cut off because he didn’t pay overdue fees and invoices. After the utility gave notice the service was to be terminated, the property requested a hearing that was never provided, so his claims may proceed against the utility. His claims against the city are dismissed because he did not identify a policy behind the alleged constitutional violation.
