Jaguars in Arizona

SAN FRANCISCO — The Ninth Circuit upheld vacatur of a U.S. Fish and Wildlife Service designation of an area in southern Arizona as occupied critical habitat for jaguar under the Endangered Species Act. An intervening copper mine successfully argued that the agency did not explain whether designating the area as occupied habitat was adequate for conservation goals, nor how current designations are insufficient.
