Lewd but not ‘open’

BOSTON — A painter who walked around his client’s home, masturbating and looking into her surveillance cameras, cannot be prosecuted for open and gross lewdness and lascivious behavior, ruled a Massachusetts appeals court. Because the victim was not home, and only documented the painter’s behavior by camera, his behavior did not occur in the presence of an alarmed or shocked person, so it was not “open.”
