MANHATTAN — Upholding $438 million in damages to Bank of New York Mellon Trust noteholders, the Second Circuit on Thursday said the amount represents the difference between what Chesapeake Energy paid for its early redemption of notes in May 2013 and the “Make-Whole Price” it should have paid for that redemption.
