<p>The Ninth Circuit <strong><a href="http://www.courthousenews.com/wp-content/uploads/2020/06/medicalmarijuanaeviction.pdf">upheld</a></strong> the dismissal of Tenth Amendment and Fourth Amendment claims brought by a woman who was evicted from subsidized housing for using medical marijuana. The woman, who claimed the U.S. Department of Housing and Urban Development improperly applied the Controlled Substances Act, failed to exhaust her administrative remedies. </p>

SAN FRANCISCO — The Ninth Circuit upheld the dismissal of 10th Amendment and Fourth Amendment claims brought by a woman who was evicted from subsidized housing for using medical marijuana. The woman, who claimed the U.S. Department of Housing and Urban Development improperly applied the Controlled Substances Act, failed to exhaust her administrative remedies.
