Militia membership

DENVER — The Tenth Circuit affirmed the dismissal of a prosecutorial misconduct lawsuit brought against a New Mexico district attorney who, when suing the New Mexico Civil Guard militia group, included a man who spoke in support of that group on a podcast named after it. The man was not a member, but had participated in some of its activities; these circumstances do not warrant waiver of the prosecutor’s absolute immunity.
