Missouri Supreme Court

INSURANCE – Plaintiffs claimed that their insurance agent promised that their policy would cover them when runoff from their horse park polluted their neighbor’s lake. The Missouri high court found that the plaintiffs failed to show that enforcement of the promise was the only remedy they had available because they also sued him for negligence. Reversed in part. Clevenger v. Oliver Insurance
