New York judge tosses kerfuffle over fudge-coated Oreos

MANHATTAN — A federal court in New York dismissed a class action alleging that “Fudge Covered Mint Creme Oreo Cookies” are misleadingly labeled because the “fudge” is made of palm oil and nonfat milk instead of sugar, milk and butter. No binding source has been offered to demonstrate that milk and butter are essential fudge ingredients or that milkfat is necessary to make fudge.
