Not His Day

NASHVILLE (CN) – After someone shot him in the head and dumped him on the railroad tracks, Francisco Moreno says, he lay immobile and could only watch as a CSX train ran over him and cut off a leg.     Moreno sued CSX in Federal Court.     Moreno says someone shot him and a companion on the night of Dec. 15, 2007, near Fogg Street and 7th Avenue. His companion died. Moreno says he was dumped on the tracks and “tried to wave or scream to no avail” as the train sounded its horn and “slowly moved down the tracks.” He says he “was unable to remove his body from the tracks and watched as the train rolled over and severed one of his legs.”     He is represented by John Allyn.
