Office Depot Sells Sham Insurance, Class Action Claims

SANTA CLARA, CALIF. (CN) – Office Depot sells a sham “performance protection plan” for computers and components it sells, a class-action complaint claims in Santa Clara County Court. Lead plaintiff Mary Sanbrook says she paid $120 for the 2-year plan, which is riddled with so many exceptions as to be “totally illusory.”She says Office Depot falsely advertises that the plan covers “100% of parts and labor from day one,” though she counts 26 exceptions to the “100%” service; that it falsely promises “on-site service for your computer system” that is available “24/7,” all of which are untrue. She seeks disgorgement and punitive damages for fraud, breach of warrant, unfair competition and negligent misrepresentation. She is represented by Scott Kaufman with California Lemon Lawyers.
