Due process for detainees

RICHMOND, Va. — The Fourth Circuit sided with a class of pretrial detainees who say Prince George’s County in Maryland puts the decision regarding whether to release a pretrial inmate in the hands of the county’s executive branch, not judges. The appellate court says municipalities cannot assert immunity defenses in lawsuits brought under Section 1983, and reinstates seven plaintiffs who were dismissed from the suit. The defendant judges remain dismissed, but without prejudice.
