Preventive care mandates

NEW ORLEANS — The United States Preventive Services Task Force won and lost at the Fifth Circuit, which declared its “unreviewable power” to issue mandates about what preventive care insurers must cover constitutionally invalid. The appellate panel only bars the Department of Health and Human Services from enforcing the mandates “to the extent they came at the recommendation of the Task Force,” however, and not other mandates such as ones properly ratified and by Secretary Xavier Becerra.
