Prisoner’s suit barred

NEW ORLEANS — The Fifth Circuit ordered a lower court to dismiss a former inmate’s civil rights and assault claims against the prison officers who severely beat him on suspicion that he had swallowed contraband, though it was later discovered he had not. Though he admits to failing to obey orders and physically resisting, he challenges his conviction and not the circumstances or conditions of his confinement, and his claims are barred.
