Procedure un-thwarted

HOUSTON — An appeals court in Texas reversed a court’s default judgment granted against an engine delivery company just 39 days after it filed its original answer. Though this was filed after the deadline, because it filed the answer before the trial court considered a default judgment, the court cannot grant default judgment based on a lack of answer.
