Self-defense and battery

WORCESTER, Mass. — An appeals court in Massachusetts vacated a criminal defendant’s sentence because the jury was not instructed on his self-defense claim. He was convicted for assault and battery after he pushed his ex-girlfriend away after she hit him with a dog leash and came at him with a broken beer bottle, following an alleged incident when he strangled the woman on the floor.
