SAN FRANCISCO — The Ninth Circuit was divided 2-1 Thursday in upholding sentencing enhancements for Medicaid fraudsters who provided power wheelchairs to people who did not need them. Patrick Sogbein and Adebola Adebimpe’s enhancements hinge on whether medical-equipment suppliers have the requisite “professional or managerial discretion” to effect an abuse of trust.
