Service animal attack

AUSTIN, Texas — The Texas Supreme Court upheld an appellate court’s finding against a doctor whose patient’s service dog attacked a child at a restaurant. The doctor says the kid’s family’s claims should be dismissed because the parents did not serve a medical expert’s preliminary report, but because the family is not stating a health care liability claim, an expert report was not required. Rather, they assert a negligence claim related to the doctor’s alleged failure to ensure that the dog was appropriately trained to behave in public.
