Three-stripe trademark battle

PORTLAND, Ore. — A federal magistrate in Oregon has recommended against the dismissal of a sports merchandise company’s trademark dilution, trade dress infringement and antidilution violations alleged by Adidas, which seeks to enforce its registered “three-stripe mark” against Hall of Fame Sports Memorabilia. The merchandiser sells soccer jerseys that sport vertical stripes Adidas claims are protected trademarks. The magistrate also recommended the court to instruct Adidas to amend its complaint to use the term “registered mark” in place of “three-stripe mark” in its complaint.
