Titanium dioxide warnings nixed

SACRAMENTO — California’s Prop 65 warning requirement related to titanium dioxide in personal care products violates the First Amendment, a federal judge ruled. A scientific debate remains over whether titanium dioxide causes cancer in humans, so the required warning is “not purely factual.” The state may not enforce the requirement as applied to airborne, unbound particles of respirable size titanium dioxide in cosmetics and personal care products.
