Tribal students sue over aid

PLATTSBURGH, N.Y. — Two members of the Saint Regis Mohawk Tribe are suing the U.S. Department of Education for requiring American Indians born in Canada to prove their permanent resident status to receive federal student aid. The department had previously recognized tribal members born in Canada — referred to as Jay Treaty students — as permanent residents, but "abruptly reversed course" in January without providing justification and in violation of the Administrative Procedure Act, according to the tribe members.
