Turtle claims mooted

SAN FRANCISCO — Conservationists’ lawsuit against the opening of leatherback sea turtle habitat to stablefish pot fishing was tossed as moot because a new biological opinion has been issued. The court acknowledges the conservationists’ concern that the government can “perpetually evade its consultation obligations by implementing noncompliant regulations and initiating consultation only after the procedural violation is challenged in order to moot that challenge.”
