ALBANY, N.Y. — The Second Circuit vacated a ruling in favor of Xerox in a dispute brought by its union, which disputes the corporation’s decision to cut health benefits for retirees in 2022 after the parties’ last contract expired in 2021. Xerox had argued that because there was no contract, the dispute could not be arbitrated, but the appellate court said that language in the last contract “could be reasonably understood” to guarantee benefits beyond contract expiration or as constituting deferred compensation.
