ATTORNEY FEES – Utahns for Better Dental Health successfully prevented an initiative to ban fluoride from city drinking water from being placed on the ballot. J. Durham found that blocking an unconstitutional initiative petition benefits the public by avoiding costs associated with fighting the initiative. Thus, Utahns should be entitled to attorney fees. Reversed. See ruling.
