Whole Foods clears false ad claims

MANHATTAN — The Second Circuit upheld the dismissal of a class action against Whole Foods for selling fish oil pills that allegedly contain fewer Omega-3s than is advertised on the bottle. The suing consumer’s arguments assume a misreading of the label, which does not say there are 1000mg of Omega-3s per serving, but that each serving contains 1000mg of fish oil.
