Wisconsin medical immunity pared back

MILWAUKEE, Wis. — A Wisconsin appeals court declared a Covid-era state law unconstitutional because it extended immunity to a hospital sued for malpractice by a woman whose baby died during childbirth. Even if the law “served the compelling state interest of responding to the Covid-19 pandemic, the statute is not narrowly tailored in furtherance of this purpose,” so strict scrutiny requires the court to toss it.
